Terms & Conditions

1. Definitions

• FirstPour — the SaaS platform offered by [Full name], a sole proprietorship run as a side business, company number 0xxx.xxx.xxx.
• Customer — any natural or legal person who takes out a FirstPour subscription.
• Service — the web-based bar management platform, including POS, queue, stock management and reporting.

2. Service provision

FirstPour is a web-based platform accessible via a browser and as a Progressive Web App (PWA). An internet connection is required for optimal use. Certain features — such as viewing the menu and open orders — remain available offline to a limited extent, via local storage.

3. Subscription and pricing

FirstPour operates a monthly subscription. The following rates apply:

• Kassa — €29/month.
• Compleet — €59/month (AI included, no separate add-on).
• Founding offer — €19/month, available for the first 20 customers, guaranteed for life as long as you remain subscribed.

All prices are excluding VAT. As a small business, FirstPour falls under the Belgian small-business VAT exemption scheme, which means VAT does not apply. Price changes are announced by email at least 30 days in advance.

4. Payment

Subscriptions are invoiced monthly in advance. The payment term is 14 days from the invoice date. In case of late payment, FirstPour reserves the right to suspend access to the service until the outstanding invoice is settled.

5. Cancellation

The customer may cancel the subscription at any time by email to info@firstpour.io. After cancellation, the service remains available until the end of the current billing period. No refunds are given for periods already paid.

6. Availability

FirstPour targets 99.5% availability on an annual basis. Planned maintenance is announced in advance by email. FirstPour is not liable for interruptions caused by force majeure, third-party outages (including Firebase and Cloudflare) or maintenance of internet infrastructure.

7. Liability

FirstPour's liability is limited to the amount paid by the customer in the three months preceding the damaging event. FirstPour is not liable for indirect damages, lost profit, loss of revenue or reputational damage.

8. Intellectual property

All intellectual property rights in the platform, the software, the design and the documentation belong to [Full name]. The customer receives a non-exclusive, non-transferable right of use for the duration of the subscription.

9. Data processing

FirstPour processes personal data in accordance with the General Data Protection Regulation (GDPR). See our Privacy Policy for a full description of processing, retention periods and your rights as a data subject.

10. Governing law and disputes

These terms and conditions are governed by Belgian law. In case of disputes, only the courts of FirstPour's place of establishment have jurisdiction. The parties commit to first seeking an amicable settlement before initiating legal proceedings.

White cash register (GKS) and tax obligations

FirstPour is deliberately not a certified white cash register (GKS). At sign-up, the customer confirms they are not subject to the GKS obligation and commits to informing FirstPour if that situation changes — based on the legal threshold of €25,000 in kitchen revenue (excl.
